You agree to provide accurate, current, and complete information when using the Services, placing an order, accessing an account, uploading content, or communicating with us. You are responsible for maintaining access to the email address and phone number you provide and for all activity associated with your account or order links.

DivinePoster provides personalized custom poster products based on the stories, traits, reference images, written notes, preferences, and other materials you submit. Custom creative work involves interpretation, and the final product may differ from what you initially imagined.

We do not warrant that the appearance, style, quality, emotional impact, or subjective meaning of any product or service will meet your expectations or match examples shown on the Services. Product descriptions, pricing, availability, and features may change at any time without notice.

When you place an order, you make an offer to purchase from DivinePoster. We may accept or decline any order for any reason at our discretion. An order is not accepted until we confirm acceptance and receive or process payment.

Please review your order carefully before submitting it. Because our products are personalized, cancellation requests may not be available after work has begun, a proof has been prepared, or production has started. If we do not accept, modify, or cancel an order, we will attempt to notify you using the information you provided.

Prices, discounts, promotions, taxes, shipping charges, and availability are subject to change without notice. The price charged for a product or service will be the price shown during checkout at the time the order is placed, subject to correction of errors.

You agree to provide current, complete, and accurate purchase, billing, payment, shipping, and account information. You represent that you are authorized to use the payment method provided and agree to pay all charges incurred at the posted prices, including applicable taxes and shipping charges.

We may provide access to order status, reference upload, proof review, and related order actions through links, account pages, email, text messages, or other service communications. You are responsible for keeping your contact information accurate and checking folders where our messages may be filtered.

If your order includes proof review, you are responsible for reviewing the proof carefully before approval. Once you approve a proof or production begins, responsibility for the approved design and the risk of issues caused by approval, incorrect information, late requests, or inaccessible contact information passes to you.

Delivery times and production estimates are not guaranteed. We are not responsible for delays caused by incomplete information, delayed proof approval, shipping carriers, third-party outages, your devices or software, incorrect addresses, force majeure events, or other causes outside our reasonable control.

The Services, including our trademarks, branding, website content, designs, images, text, software, product previews, layouts, and related materials, are owned by us, our affiliates, or licensors and are protected by intellectual property laws.

Personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read and understand that policy.

If you submit ideas, suggestions, feedback, reviews, proposals, plans, or other comments, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that feedback in any medium for any purpose, including commercial use. We have no obligation to keep feedback confidential, pay compensation, publish it, or respond.

You may access and use the Services only for lawful purposes. You may not:

We are not responsible for third-party content, policies, availability, accuracy, products, services, or actions. Your use of third-party services is at your own risk and may be governed by their own terms and policies.

Information on or through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping, delivery estimates, availability, or other matters. We reserve the right to correct errors, update information, change or cancel orders, or refuse service if information is inaccurate, including after an order is submitted.

We may suspend, disable, or terminate your access to the Services at any time, with or without notice, if we determine that you violated these Terms or that termination is appropriate to protect the Services, our business, our customers, or others. Provisions that by their nature should survive termination will survive, including intellectual property, licenses, payment obligations, disclaimers, limitation of liability, indemnification, dispute terms, and other protective provisions.

Except as expressly stated by us, the Services and all products are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or uninterrupted operation.

We do not guarantee that the Services will be secure, timely, uninterrupted, error-free, or available at all times, or that any product will meet your subjective expectations. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

To the fullest extent permitted by law, DivinePoster, its affiliates, officers, directors, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost savings; loss of data; replacement costs; emotional distress; or similar damages arising from or related to the Services, products, or these Terms.

To the maximum extent permitted by law, our total liability for any given purchase will not exceed the amount actually received by us from you for that purchase, net of any refunds, chargebacks, credits, payment processor fees, production costs, and fulfillment costs. At our option, we may satisfy any such liability by re-delivering the applicable product or issuing a refund. These are your sole and exclusive remedies where permitted by law.

You agree to indemnify, defend, and hold harmless DivinePoster, its affiliates, officers, directors, employees, agents, contractors, service providers, and licensors from and against any losses, damages, liabilities, claims, demands, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your breach of these Terms, your content or submitted materials, your violation of law, your violation of a third-party right, or your access to or use of the Services.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed if necessary, and the remaining provisions will remain in full force and effect.

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with policies incorporated by reference, constitute the entire agreement between you and us regarding the Services.

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign or transfer these Terms and our rights and obligations without notice or consent.

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Texas, without regard to conflict-of-law rules.

To the maximum extent permitted by law, disputes will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules and governed by the Federal Arbitration Act. Class, collective, and representative actions are not permitted, and you and we waive any right to a jury trial. Either party may bring an individual claim in small claims court or seek temporary or permanent injunctive relief in court to protect intellectual property or prevent unauthorized access or misuse of the Services.

Because DivinePoster products are custom and personalized, all sales are generally final once work has begun, a proof has been prepared, the product has entered production, or delivery has occurred. Cancellation requests must be submitted promptly to orders@divineposter.com and may be approved or declined at our sole discretion based on order status.

Custom-manufactured physical products made to your specifications are final and non-refundable once you approve the proof or production begins. Please review your proof, spelling, names, dates, image choices, shipping address, and all details carefully before approval.

If we are unable to deliver substantially as described due to an error on our part, we may, at our option, re-deliver the product, correct the issue, or provide a refund. Approved refunds will be issued to the original payment method when possible. Processing times vary. Payment processing fees, production costs, fulfillment costs, shipping, and other third-party costs may be non-refundable where permitted by law.

By providing your mobile phone number and opting in to receive text messages from DivinePoster, you consent to receive recurring automated transactional and, where permitted, promotional SMS/MMS messages through your wireless provider to the mobile number you provided. Consent to promotional text messages is not a condition of purchase.

Message frequency varies. Message and data rates may apply. You are responsible for charges imposed by your wireless carrier. You may opt out at any time by replying STOP to a text message, and you may request help by replying HELP or contacting us.

We may update, change, or replace any part of these Terms by posting updates on this page. Your continued use of or access to the Services after changes are posted constitutes acceptance of those changes.
